General Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions the following definitions apply:

Seller:
Slijperij J.M. van Rangelrooij, operating under the name Hamono.nl.

Consumer:
A natural person acting outside the scope of business or professional activity.

Business Customer:
Any natural or legal person acting in the course of business or profession.

Agreement:
The distance contract concluded between Seller and Consumer.

Product:
All goods offered by the Seller, including knives and accessories.

Service:
Any service provided by the Seller, including sharpening services.

Right of Withdrawal:
The Consumer’s right to withdraw from the Agreement within 14 days.

Article 3 – Applicability

  1. These Terms and Conditions apply to all offers, orders and Agreements via Hamono.nl.

  2. Deviations are only valid if agreed in writing.

  3. Any general terms and conditions of the Consumer or Business Customer are expressly rejected.

  4. If any provision is invalid or voidable, the remaining provisions remain fully applicable.

Article 4 – The Offer

  1. All offers are non-binding.

  2. Obvious errors or mistakes do not bind the Seller.

  3. Product images are for illustration purposes only; knives are handcrafted and may vary.

  4. Prices include VAT and exclude shipping costs, unless stated otherwise.

Article 5 – The Agreement

  1. The Agreement is concluded when the Consumer accepts the offer and payment is successfully completed.

  2. The Consumer receives an order confirmation by e-mail.

  3. The Seller reserves the right to refuse an order for justified reasons.

Article 6 – Right of Withdrawal (Consumers)

Products

  1. The Consumer has the right to withdraw from the Agreement within 14 days after receipt of the Product, without stating reasons.

  2. During the withdrawal period, the Consumer shall handle the Product with care and may only use it as would be permitted in a physical store.

  3. Withdrawal may be communicated via e-mail or by using the model withdrawal form.

  4. After withdrawal, the Product must be returned within 14 days.

Refund

  1. All payments received will be refunded within 14 days after withdrawal, provided the Product has been returned or proof of return has been supplied.

Article 7 – Costs in Case of Withdrawal

  1. Return shipping costs are borne by the Consumer.

  2. Any depreciation in value caused by handling beyond what is necessary may be charged to the Consumer.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  1. Custom-made or personalized Products (e.g. engravings or custom handles).

  2. Services fully performed with the Consumer’s explicit consent.

  3. Sharpening services for knives supplied by the Consumer.

These exclusions are clearly stated prior to concluding the Agreement.

Article 9 – Prices

  1. All prices include VAT.

  2. Price changes do not affect Agreements already concluded.

  3. Shipping costs are clearly stated before checkout.

Article 10 – Conformity and Warranty

  1. Products conform to the Agreement and reasonable expectations.

  2. Statutory warranty rights apply.

  3. Normal wear, improper use, damage caused by incorrect cutting surfaces or poor maintenance are excluded from warranty.

  4. In case of non-conformity, the Seller may repair, replace or refund the Product in accordance with the law.

Article 11 – Delivery and Risk

  1. Delivery takes place at the address provided by the Consumer.

  2. Delivery times are indicative.

  3. The risk of loss or damage passes to the Consumer upon actual delivery of the Product.

Article 12 – Payment

  1. Payment must be made using the available payment methods.

  2. In case of non-payment, the Seller may dissolve the Agreement.

Article 13 – Complaints

  1. Complaints must be submitted within a reasonable time after discovery.

  2. Complaints are answered within 14 days.

  3. If no solution is reached, the Consumer may contact WebwinkelKeur or the EU ODR platform.

Article 14 – Disputes

  1. Dutch law applies to these Terms and Conditions.

  2. Disputes shall be submitted to the competent court in the Netherlands.

Article 15 – Liability

  1. The Seller is not liable for damage caused by improper or unsafe use of Products.

  2. Liability is limited to the order value, unless mandatory law provides otherwise.

Article 16 – Retention of Title

Ownership of Products transfers only after full payment has been received.

Article 17 – Intellectual Property

All intellectual property rights relating to Products and content belong to the Seller or its suppliers.

Article 18 – Force Majeure

In the event of force majeure, the Seller may suspend or terminate its obligations under the Agreement.

Article 19 – Final Provisions

  1. These Terms and Conditions comply with Dutch and European consumer law.

  2. The Seller may amend these Terms; the most recent version applies.
